Borrow It – Terms & Conditions

As an owner, I acknowledge and agree that:

• I am the lawful owner of the item, property, equipment, or service being offered, or I have the legal authority to offer it.
• Any item I make available is safe, clean, and in proper working condition at the time of pickup or delivery unless otherwise clearly disclosed in writing.
• Any labour or service I provide will be performed honestly, competently, and in accordance with applicable laws.
• I will provide all reasonably necessary operating instructions, warnings, and safety information before the borrower or recipient takes possession of the item or receives the service.
• I will disclose all known defects, hazards, limitations, damage, or operational concerns before the transaction is completed.
• My listing accurately describes what is being offered.
• I understand that payments are made directly between users unless Borrow It specifically states otherwise.

As a borrower or recipient, I acknowledge and agree that:

• I will use reasonable care while using any borrowed item, rented property, equipment, or received service.
• I will follow all operating instructions, warnings, manufacturer recommendations, and applicable laws.
• I assume responsibility for any damage, theft, or loss occurring while the item is in my possession or control unless otherwise agreed.
• I will immediately notify the owner of any damage, malfunction, injury, accident, theft, or other incident.
• I am responsible for pickup, return, transportation, and payment unless otherwise agreed.

Borrow It does not process or hold payments unless expressly stated within the platform.

Unless otherwise indicated:

• Payment arrangements are solely between the owner and borrower.
• Security deposits are negotiated directly between users.
• Owners are responsible for determining whether a deposit is required.
• Borrowers remain responsible for any damage that exceeds the value of a deposit.
• Late fees, repair costs, replacement costs, cleaning fees, fuel charges, or other agreed charges remain the responsibility of the borrower where applicable.

Borrow It does not guarantee payment collection or debt recovery.

Unless users agree otherwise:

• Owners should provide as much notice as reasonably possible when cancelling.
• Borrowers should provide reasonable notice if they no longer require the booking.
• Refunds, deposits, cancellation fees, and rescheduling arrangements are solely between the users.

Borrow It is not responsible for financial losses arising from cancellations.

The following may not be listed, offered, requested, or facilitated through Borrow It:

• Illegal drugs or controlled substances.
• Firearms, prohibited weapons, explosives, ammunition, or regulated weapons where prohibited by law.
• Stolen property.
• Counterfeit goods.
• Dangerous chemicals or hazardous materials.
• Live animals where prohibited by law.
• Illegal gambling services.
• Adult or sexual services.
• Services involving illegal activity.
• Fraudulent financial services.
• Medical services requiring professional licensing where appropriate licensing cannot be verified.
• Any item or service prohibited under applicable municipal, provincial, federal, or international law.

Borrow It also reserves the right to remove any listing that, in its sole discretion, presents an unreasonable safety, legal, ethical, or reputational risk.

Users remain solely responsible for ensuring their listings comply with all applicable laws.

Borrow It is an online marketplace that introduces independent users.

Borrow It and Kaskata Key Operations Ltd. do not own, inspect, supervise, certify, endorse, test, warrant, or guarantee:

• any user;
• any listing;
• any item;
• any equipment;
• any vehicle;
• any property;
• any labour;
• any service; or
• any transaction.

Borrow It is not a party to agreements entered into between users.

Users acknowledge that borrowing, lending, renting, providing, transporting, receiving, or using items, equipment, vehicles, property, labour, or services involves inherent risks.

These risks include, but are not limited to:

• property damage;
• equipment failure;
• theft;
• financial loss;
• illness;
• bodily injury;
• permanent disability; and
• death.

Each user voluntarily accepts these risks.

To the fullest extent permitted by law, users agree that Kaskata Key Operations Ltd., Borrow It, and all directors, officers, employees, contractors, volunteers, affiliates, moderators, agents, successors, and representatives shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of or related to:

• any item;
• any equipment;
• any property;
• any labour;
• any service;
• any user;
• any listing;
• payment disputes;
• cancellations;
• delays;
• transportation;
• theft;
• fraud;
• property damage;
• equipment damage;
• data loss;
• personal injury;
• illness;
• disability; or
• death.

Users expressly release and hold harmless Kaskata Key Operations Ltd., Borrow It, and all associated personnel from any claims, actions, damages, liabilities, costs, expenses, or legal proceedings arising from participation in the Borrow It platform, except where liability cannot legally be excluded under applicable law.

Users agree to:

• treat others respectfully;
• communicate honestly;
• provide accurate information;
• comply with applicable laws;
• avoid harassment, discrimination, threats, intimidation, or abusive behaviour;
• refrain from fraudulent or misleading conduct.

Borrow It reserves the right to suspend or permanently remove accounts that violate these Terms.

Borrow It does not investigate or resolve disputes between users.

Users acknowledge these Terms form part of the agreement between the parties and may be relied upon in legal proceedings, including proceedings before the Provincial Court of British Columbia (Small Claims Court), where applicable.

To help maintain a safe and trustworthy marketplace, Borrow It reserves the right, at its sole discretion, to verify the identity of any user at any time.

Users may be required to provide information or documentation to verify their identity, age, ownership of listed items, authority to offer a property or service, or any other information reasonably required to promote the integrity and security of the platform.

Borrow It may suspend, restrict, remove, or permanently terminate any account or listing, without prior notice, where it reasonably believes that a user has:

• provided false, misleading, or fraudulent information;
• impersonated another person;
• listed stolen, counterfeit, illegal, or prohibited property or services;
• violated these Terms & Conditions;
• engaged in fraudulent, abusive, unsafe, or unlawful conduct; or
• otherwise created a risk to other users or to the Borrow It platform.

Borrow It may remove any listing or account at its sole discretion where it believes doing so is necessary to protect users, comply with applicable laws, preserve the integrity of the platform, or reduce legal or safety risks.

Where required or permitted by applicable law, Borrow It and Kaskata Key Operations Ltd. may cooperate with law enforcement agencies, regulatory authorities, insurers, or courts, including by preserving or disclosing relevant account information, communications, or records in response to lawful requests, investigations, court orders, or legal obligations.

Borrow It does not conduct criminal background checks on users unless expressly stated and does not guarantee the identity, honesty, qualifications, experience, or conduct of any user. Users remain responsible for exercising their own judgment and taking appropriate precautions before entering into any transaction.

By using Borrow It, each user consents to the following limited sharing of their contact information:

• After a borrow arrangement is marked as completed on the platform, either the owner or the borrower involved in that specific arrangement may choose to reveal the other party's legal name and email address in order to resolve issues arising from that borrow (such as damage, unreturned items, injury, or payment disputes).
• Revealing this information requires the requesting user to spend one (1) Thunder Totem, and both parties consent to this reveal as a condition of using Borrow It.
• This information is only shared in connection with a completed borrow arrangement between the two users involved in that arrangement. It is not shared for marketing, general directory access, casual browsing, incomplete or cancelled arrangements, or any other purpose.
• Users are responsible for keeping their legal name and email address accurate for this purpose, and agree not to misuse contact information obtained through this feature (including for harassment, spam, or any purpose unrelated to the completed borrow).

Borrow It may amend these Terms from time to time.

Continued use of the platform after changes have been published constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

By creating an account or using Borrow It in any manner, users confirm that they have read, understood, and agree to these Terms & Conditions.
